In supersession of this Department's letter of even number
dated 16.08.2018, and in continuation of this Department's letter of even
number dated 29.05.2018 on the subject cited above, I am directed to say that
it has been observed that in some cases, approval of the Hon'ble Chief
Minister for "Not to be Disturbed" in respect of a particular employee is
conveyed . Lateron, orders are conveyed in supersession of all previous
orders, in respect of some other employee for his transfer against the post
held by such employee for whom "not to be disturbed" orders have been
conveyed earlier, besides, in the some cases, relaxation in the policy with
regard to transfer/posting of an employee to his Home division/adjoining circle
etc., which is not allowed in normal circumstances, is required . In order to
remove these ambiguities, henceforth, the following procedure will be
followed:-
(1 ) In the cases, where approval of the Hon'ble Chief Minister for
"Not to be disturbed" in respect of a particular employee is
conveyed and lateron, orders are conveyed in supersession of all
previous orders in respect of some other employee for his
transfer against the post held by such employee for whom "not to
be disturbed" have been conveyed, the proposal will be put up
to the Hon'ble Chief Minister, on the departmental file for
reviewing both previous orders and to pass fresh orders i.e.
either to change the "Not to be disturbed" orders or to
implement the orders " in supersession of all previous
orders".
